The fine print, kept short.

These Terms & Conditions (“Terms”) govern your access to and use of the Clout iOS application and related services (the “Service”), operated by Clout (“Clout,” “we,” “us”). By downloading, installing, or using the Service, you agree to these Terms.

The Service

Clout uses artificial intelligence to analyze short-form videos. It can predict how a video you submit may perform on platforms like TikTok, and analyze publicly available TikTok videos to explain why they did or did not perform well. Features may change over time.

Your account

You need an account to use most features. You’re responsible for the activity on your account and for keeping your login credentials secure. You must be at least 13 years old to use Clout — and old enough under the law of your country to enter into a contract.

Acceptable use

You agree not to:

• Upload content you don’t own or have the rights to analyze
• Submit content that is illegal, harassing, hateful, sexually exploitative of minors, or otherwise violates applicable law
• Use the Service to attack, reverse engineer, scrape, or overwhelm our infrastructure
• Resell, rebrand, or otherwise commercialize the Service without our written permission
• Use the Service to violate the terms of service of TikTok, Apple, or any other third-party platform

We may remove content and suspend or terminate accounts that violate these Terms.

AI output

Clout’s analysis is generated by AI. Predicted scores, engagement estimates, and recommendations are opinions, not promises. Going viral depends on many factors outside of any tool’s control. You are solely responsible for what you choose to post and how you use Clout’s suggestions.

Third-party content

When you paste a TikTok URL, Clout retrieves publicly available metadata about that video through a third-party service. We don’t own that content and we don’t claim any rights to it. Use of third-party content remains subject to the original platform’s terms.

Your content

You keep all rights to videos you upload. You grant us a limited license to process those videos for the sole purpose of running the analysis you requested. We don’t use your videos to train third-party AI models, and we don’t share them with anyone outside the providers we use to deliver the Service.

Subscriptions and payments

Some features require a paid subscription or one-time purchase, sold through Apple’s App Store. Pricing, renewal terms, and free trial details are shown in-app at the point of purchase. Auto-renewal can be turned off in your Apple ID settings at least 24 hours before the end of the current period. Refunds are handled by Apple under their standard refund policy.

Termination

You can stop using Clout at any time and delete your account from the Settings tab. We may suspend or terminate access if you violate these Terms or if running the Service for you is no longer feasible. On termination, your right to use the Service ends.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI predictions will be accurate.

Limitation of liability

To the maximum extent permitted by law, Clout will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service. Our total liability for any claim under these Terms will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US $50.

Changes

We may update these Terms from time to time. If we make material changes, we’ll let you know in-app or by email. Continued use of the Service after the changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the United States and the state where Clout’s operating entity is registered, without regard to conflict-of-laws rules. Disputes will be resolved in the courts located there, unless a different venue is required by applicable consumer law.
